Jewish Tribune: Discrimination and Evaluation

Balancing the conflicting rights of individuals has now become a hot topic in Canada with discussions even of whether a doctor can refuse to do an abortion or whether this refusal in a violation of the rights of an individual. An article on this broad subject, by Nishma's Founding Director, Rabbi Benjamin Hecht, was recently published in the Jewish Tribune (Toronto). It should be clarified that the recent proposol by the College of Physicians & Surgeons of Ontario was not about forcing unwilling doctors to do abortions. This would be impossible as a doctor could simply remove his privileges for that procedure at his hospital and therefore be legally unable to do it. How could he be forced into it?
The proposol occured because some doctors, in addition to not performing the procedure, would refuse to counsel the patient on the risks and benefits or provide any information on doctors who did perform it. This, however, has always been considered the standard of care.
The real concern was the Human Rights Commission but logic and reason do not come into play when considering their thinking.
